PRIVACY POLICY — QB CARE DISABILITY SUPPORT SERVICES

1. OBJECTIVES OF IMPLANT REGISTRIES

QB Care Disability Support Services Pty Ltd (ABN 16 648 634 548) of 67 Goodwood Road, Wayville SA 5034 (“QB Care”) provide a number of services that empower individuals with disabilities to live their best lives including supported independent living (SIL), in-home support, community participation support and developmental education (QB Care Services).

QB Care is required to comply with the Privacy Act 1988 (Cth) (“Privacy Act”), the Australian Privacy Principles (APPs), and other legislation when handling personal information, including sensitive information. Personal information means information or an opinion about an identified individual or an individual who is reasonably identifiable. Sensitive information is personal information that includes information or an opinion about an individual’s health or genetic information and racial or ethnic origin. It does not matter if this information is true or not, or if the information or opinion is recorded in material form or not.

By entering into a Services Agreement with us, using our website, and/or providing your personal information to us, you consent to us handling your personal information, including sensitive information, in accordance with this Privacy Policy.

This Privacy Policy is intended to apply to most personal information handled by us, but is not exhaustive as other conditions may apply to some specific personal information. If you have any queries about our management of your personal information, you should contact the QB Care Privacy Officer for further information.

In this policy, the terms ‘we’, ‘us’ and ‘our’ refer to QB Care. The terms ‘you’ and ‘your’ refer to people whose personal information QB Care may collect.

2. POLICY

2.1 Collection of personal information

We collect information about you that is necessary to perform the functions and activities of QB Care.

The personal information, including sensitive information, we collect may be:

  • (a) from you directly, in person, by telephone or email or in writing or by other communications media, as a participant receiving services from QB Care or otherwise;
  • (b) from your health care practitioners with your consent;
  • (c) from you indirectly, when you interact with our website and social media accounts;
  • (d) from publicly available sources; and
  • (e) from third-party sources, including data collected and shared by external providers, data partners and advertising networks such as aggregated behavioural data or audience segments and also publicly available information (like social media platforms) where you consent to the use or disclosure.

 

When collecting your personal information and sensitive information, we take reasonable steps to provide you with certain information as required under the APPs, including purpose of collection, the types of organisations or people to whom we may disclose your personal information, any law that requires or authorises us to collect the information and the main consequences if we do not collect all the personal information we require. If we collect personal information from another source, we will take reasonable steps to ensure you are aware of this and the reasons for the collection.

2.2 Personal information we collect

We collect limited personal information, including sensitive information, about you. The information we collect includes:

  • (a) details such as your name, phone number, email address and address;
  • (b) information from your health care providers with your consent;
  • (c) payment details, such as credit cards and bank account details;
  • (d) information obtained from your use of our website, such as location settings, demographic information, preferences and browsing behaviour; and
  • (e) information from your directly that is necessary to perform QB Care Services in the most beneficial way for you as a participant.

We may also collect other personal and sensitive information from you about matters such as:

  • (i) your health;
    results of assessments of your health and needs;
  • (ii) other personal information collected to provide, or in providing, our services to you.
  • (iii) The expression ‘sensitive information’ includes information about your health.

We will only collect sensitive information with your consent and if the information is reasonably necessary for one or more of our functions or activities. Sensitive information will only be used by us for the purpose for which it is collected or directly related to a secondary purpose and as otherwise permitted by law.

2.3 Cookies

We may use “cookies” on our website. A cookie is a small text file that we may place on your computer and are usually used as a means for our website to remember your preferences and are designed to improve your experience of our website. Cookies may collect and store personal information about you.

We take no responsibility for third party internet sites practices or policies and are not liable for any loss or damage suffered from the use of these sites. You should refer to the third parties’ own privacy policy.

2.5 Use and disclosure of your personal information

We will use and disclose your personal information for the purpose for which we collected it, and for other related purposes and for sensitive information directly related, that you would reasonably expect, and as otherwise permitted or required by law.

Generally, these purposes will include:

  • (a) Storing information for future reference by you and our authorised staff, to assist in providing you with our services;
  • (b) Conducting an audit of the data held to determine any identified issues and to investigate those issues;
  • (c) Providing you with notices about our services to you;
  • (d) Managing and responding to correspondence and enquiries from third party individuals and organisations with your consent if the data provided can identify you;
  • (e) Disclosing to third party contractors and service providers who help us to operate our website and provide QB Care services to you;
  • (f) Disclosing between our related entities to help us ensure that your personal information remains up-to-date and complete, and so that we may better understand and meet your needs and interests;
  • (g) Issuing surveys directly to you, and otherwise client research and analysis;
  • (h) Direct marketing: sending direct marketing material such as promotions, products and services provided or offered by us, unless you notify us that you no longer wish to be sent direct marketing material;
  • (i) Screening for potential risk and fraud;
  • (j) Complying with our legal, recording, compliance and regulatory obligations;
  • (k) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
  • (l) Defending or enforcing our legal rights in legal proceedings;
  • (m) Providing information in an emergency as required under the Privacy Act;
  • (n) To fulfill any other purpose for which you provide it, or in any other way we may describe when you provide the information; and
  • (o) For other purposes with your consent.

 

By providing us with your personal information or allowing us to collect your personal information, you consent to us using your personal information including sensitive information for these purposes.

When we have to send your personal information to contractors or service providers to carry out work on our behalf, or to our related bodies corporate, we will take reasonable steps to notify these organisations and request that they comply with this Privacy Policy and, in certain situations we may require a confidential undertaking to protect your personal information.

We do not sell your personal information to others.

2.6 Sensitive information and participation in research

We will only collect sensitive information about you with your consent. We will assume that you have consented to us collecting information which is provided to us by you for use in accordance with this policy, including any ‘sensitive information’, unless you tell us otherwise.

Sensitive information will only be used by us for the purpose for which it is collected or directly related to a secondary purpose and as otherwise permitted by law.

2.7 Security of your personal information

We keep your personal information stored in both electronic form (using our IT systems), and in paper form (when it is provided to us or prepared by us in hard copy).

We may use some third-party providers that provide data-storage related services.

We may combine or link personal information we hold about you to help us form a better understanding about you.

We take reasonable and appropriate steps to protect and safeguard your personal information against unauthorised disclosure, loss or misuse. The electronic and procedural safeguards we have in place to manage security risks associated with your personal information include the use of antivirus software and protection, and secure premises. We will also only allow those who require it to have authorised access to your personal information and require them to treat personal information as confidential unless it is otherwise in the public domain.

Unfortunately, no data transmission can be totally secure, and we cannot guarantee unauthorised access to your personal information will not occur. Any personal information you provide us will be provided at your own risk. Provided that we take such steps as are reasonable in the circumstances to protect the information from misuse, interference and loss and from unauthorised access, modification or disclosure, and subject to the mandatory operation of law, we are not liable for events arising from any unauthorised access to your personal information. However, if you become aware of a security breach involving your personal data, please contact us.

We will take all reasonable steps to destroy or permanently de-identify your personal information and sensitive information when it is no longer required for the purpose that it was collected. We may retain your personal information and sensitive information for as long as necessary to comply with any applicable law, regulations and codes. Your personal information may be retained in our IT system back-up records.

2.8 How to seek access to and correction of personal information

An individual has a right to access personal information including sensitive information about himself or herself held by QB Care under the Privacy Act. An individual also has a right under the Privacy Act to request QB Care to correct his or her personal information.

You may lodge a request to correct your personal information including sensitive information that we hold about you if you believe that information is inaccurate, incomplete, out-of-date, irrelevant or misleading. You may also lodge a request to access the personal information that we hold about you for any reason.

You must direct any request to the QB Care Privacy Officer via the contact details below. We may charge a fee for providing access, which will not exceed our reasonable expenses incurred in responding to your request, including photocopying and other administrative expenses. We may require you to satisfy identity validation procedures to prove that the individual requesting personal information is the individual to whom the personal information relates.

2.9 The European Union General Data Protection Regulation

The General Data Protection Regulation (GDPR) is the European Union (EU) data protection law. Any Australian organisation that offers goods or services to person in the EU or targets or monitors the behaviour of persons in the EU may be required to comply with the GDPR.

QB Care is an Australian based organisation that provides services within Australia. However, we may receive information from a source based in the EU.

When this happens, we will use any and all personal information received in accordance with this Policy.

Where your personal information is processed in, collected from, or monitored in the EU, you may have additional rights. These may include:

  • (a) The right to request that we delete such personal information (unless we require that information to comply with legal obligations, or need it to bring or defend a legal claim); and
  • (b) The right to restrict our processing of such personal information (where it is inaccurate, would be unlawful to process, or where it has been deleted due to us needing it to meet a legal obligation).

3. CHANGES TO OUR PRIVACY POLICY

We reserve the right to amend, modify or replace this policy at any time. However, we will review it at least once every two years. If we update our privacy policy, we will inform you via an alert on our website. We encourage you to review our privacy policy each time you visit our website or provide us with personal information.

4. MAKING A COMPLAINT

You can make a complaint to us if you believe we have breached your rights under the APPs or the GDPR. Please contact our Privacy Officer via the below contact details. The Privacy Officer will treat any request or complaint respectfully and confidentially. We will confirm receipt of your complaint and advise you of the time frame we require to investigate your complaint and provide you with a response. We are committed to working with you to resolve any concerns or complaints in an effective and timely manner.
